1. Privacy Principles

1.1 Train With Us Pty Ltd ABN 33 664 876 377 trading as Train With Cass (“we”, “our”, “us”) and its subsidiaries and affiliates are committed to maintaining the privacy and confidentiality of personal information. We believe that the responsible use of personal information collected is critical to our business objectives and reputation.
1.2 We have elected to be subject to the Privacy Act 1988 (Cth) and accordingly will adhere to the Australian Privacy Principles (APPs) when collecting, using, disclosing, securing and providing access to personal information.
1.3 As part of our commitment to privacy, we have adopted this Privacy Policy which deals with the management of personal information.
1.4 We will only collect, use or disclose personal information in accordance with the Privacy Act 1988 and this Privacy Policy.
1.5 The contents of this Privacy Policy are subject to change and are not intended to create a contract between us and any individual or entity that provides us with personal information. We recommend that you regularly review our Privacy Policy.

2. Personal Information Collection

2.1 Personal information is any information, including any opinion, about an identified individual, or an individual who is reasonably identifiable, including:

(b) Whether the information or opinion is recorded in material form or not.
2.2 Sensitive Information is personal information, which is given a greater level of protection under the Australian Privacy Principles, such as information about your health, criminal records, your religious beliefs or affiliations or political opinions. We only collect such information where we are permitted to do so under the Australian Privacy Principles and if such information is necessary to provide our services to you or where we are required to collect this information by law.
2.3 We may invite you to provide information about yourself so that we are able to better provide and improve our services to you. The type and amount of information necessary will vary depending on the services you require and how you choose to engage with us.
2.4 The extent and type of personal information we receive from you depends on the information you provide to us through our website, apps, email, telephone, face to face dealings and/or when you request services.
2.5 In order for us to provide you with our services or otherwise to deal with you we generally require the following:

The above information will be retained for up to 18 months from the date you cancel your subscription or cease using our services or unsubscribe from our email list. You can request for us to delete your data at any time after you cancel your subscription, cease using our services or unsubscribe from our mailing list. We will action your cancellation request as soon as practical after receipt of the same.
2.6 Where it is lawful and reasonable to do so, you can remain anonymous or use a pseudonym if you wish, however it may reduce the type and quality of services we will be able to provide.
2.7 If you elect to not provide us with certain personal information about you, we may not be able to provide you with the services and assistance (to the extent that they require us to collect, use or disclose personal information).

3. Use and Disclosure of Personal Information

3.1 We use the personal information which you provide to deliver the services most suited to your needs.

7.1 Where Our Services may contain links or references to third party websites. These websites are outside of our control, and the privacy policies of these sites may differ from our own. Please be aware that we have no control over these third-party websites and our Privacy Policy does not apply to such websites. We encourage you to check the terms of use and privacy policies of such websites before disclosing any personal information via such websites.

8.1 We are committed to protecting your personal information from misuse and loss, and from unauthorised access, modification and disclosure, and will take reasonable steps to do so.
